Sample Ownership Documentation

All ownership arrangements involving multiple owners should be the subject of an appropriate written agreement (which should be entered into either prior to or immediately upon the establishment of the arrangement) detailing the rights and obligations of the parties, including proper procedures for the appointment/replacement of a Syndicate manager and or Racing manager, trainer, dispute resolution and termination. 

The attached sample agreements and Product Disclosure Statement are intended as a guide only and no responsibility will be taken by eitherthe the Author or ATLAS (including any member of ATLAS) for the appropriateness or adequacy thereof in the event of their unauthorized use by any person. 

1.  Most simple form of co-ownership or partnership agreement (should only be considered for use in relation to non commercial private groups of co-owners).

2.  Short form Partnership Agreement (should only be considered for use in relation to either non commercial private groups of owners or syndicates where shares are offered for sale by direct personal offer only).

3.  Comprehensive Partnership Agreement (should be considered for use in relation to syndicates where shares are offered for sale by public offer under a Lead Regulator approved Product Disclosure Statement.

4.  Sample form of Product Disclosure Statement (“PDS”) (should be considered for use in relation to Lead Regulator approved Syndicates where the licensed promoter is intending to offer shares for public sale. (Links to be attached)
